Know the Difference: Get Legal Medical Marijuana in Licensed Dispensaries

Author: Jasmin

Ever since the sovereign voters of the proud state of Colorado has voted to make medical marijuana legal in their region, many Denver dispensaries have appeared to cater to the needs of patients. With President Obama ordering a status quo that has effectively stymied the prosecution of possession and distribution of marijuana, these dispensaries are thriving under the blanket of legitimacy. Patients suffering from several ailments including nausea, vomiting, lack of appetite and various other diseases stand to benefit from being legally able to procure medical marijuana for their needs.

Know however, that even though you are able to purchase from Denver dispensaries, that doesn't mean that you can transport them into states which still do not have medical marijuana legalization. Also, minors are disqualified from getting and applying for a medical marijuana license card although the Colorado State Department of Health has guidelines for special conditions. Patients also have to secure prescription from a duly licensed medical doctor prior to acquiring a medical marijuana license card.

It is essential to know your rights and limitations whenever procuring this substance so you can avoid possible jail time. Remember that possessing marijuana is still illegal under federal law and that the temporary lull in prosecution is not an indication of legalization. It would be wise to be familiar and to be acquainted with the laws governing your area. Various guidelines are implemented with regards to the operation of these dispensaries. So if you can see that a dispensary is not operating with the guidelines as set forth by the State government, then do look for another one in order to be safe. One such guideline prohibits the operation of a medical marijuana dispensary within 1000 km of a school. If you see that the dispensary you are buying from is near a school, do know that it's highly likely that it is not operating within the bounds of the law.

Get medical marijuana treatment with Medical Marijuana Card

Author: amelia

We have known marijuana plant as a drug and its use has been prohibited ever since. Despite some reported medicinal properties of marijuana plant, it was not given much attention. Until lately, it is being studied and is seen to cure many diseases that afflict many people around the globe. To be given treatment with marijuana, you must secure first medical marijuana card. In acquiring medical marijuana card, you must ensure that the doctor you contacted for this is a medical marijuana doctor. He should possess a medical marijuana license. Qualified and certified professional doctors will set an appointment with you and make a medical examination to see if you really need to be treated with marijuana. This is done in proper medical marijuana clinic.

Do not be deceived by some companies that provide counterfeit recommendations. You should be able to delineate if you are dealing with the rightful authorities to avoid having problems with the law. If the law finds your card to be not genuine, you are subject for imprisonment or payment of penalties. Therefore, you must not trust any issuing company that transact and gives recommendation only through phone. Be cautious of some companies that issues counterfeit cards. Getting a medical marijuana card involves various steps and quite a long process before you can get an approval. Several forms are to be correctly filled-up and processed before you will be approved to have a medical marijuana card.
Patients with cancer, glaucoma, HIV or AIDS, cachexia, multiple sclerosis and those who suffer from severe pain, nausea resulting from chemotherapy for cancer treatment, seizures, and persistent muscle spasm can be legally treated with medical marijuana. It could also be used to treat arthritis, brain injury due to stroke, migraines and eating disorders. When one of these conditions is present, the patient will be issued a medical marijuana card.
You can now legally buy medical marijuana medicines when you already have the card. In Colorado, a law called Amendment 20 was approved that allows a patient to have in his possession up to 2 ounces of medical cannabis and grow up to six plants. Medical cannabis is another term for medical marijuana. There are already 13 states in the United States of America that have already enacted laws to make the use of marijuana legal. In addition to Colorado, the other states are Alaska, California, Hawaii, Maine, Michigan, Montana, Nevada, New Mexico, Oregon, Rhode Island, Vermont and Washington. Also, there are now other countries that have also legalized the use of marijuana to treat patients with debilitating conditions. These countries include Canada, Portugal, Italy, Netherlands, Germany, Austria, Spain, Finland and Israel.
The laws relating to the legal use of marijuana are subject to certain conditions and limitations so as not to abuse the use of this plant that is recognized to be prohibited in the earlier days. Although many countries have now seen its medicinal effects to persons in very weak conditions, there are still considerable arguments regarding its effectiveness. Some physicians are concern of its possible side effects.

Federal Government Is Impelled to Support Medical Marijuana by the American Medical Association

Author: amelia

The American Medical Association, which is the largest doctors' organization in the USA, has reconsidered its position towards medical marijuana and currently supports exploration and medical research on marijuana for medicinal use. On Tuesday, the group has persuaded the federal government to re-evaluate its controlled substance categorization of marijuana in Schedule I, which unfairly maligns the plant alongside with some of the most hazardous narcotic substances, such as LSD and heroin.

AMA officer of board, Dr. Edward Langston specifies that just a least number of controlled, casual tests have ever been maintained on ingested marijuana in spite of medical research in by medical marijuana doctors and other experts, which encompasses more than thirty years. As for now, the group encourages new researches on medical marijuana's effectiveness in spite of its support for the classification of marijuana in Schedule I, since 1997, because more and more medical marijuana doctors appear over time.

This year, Obama's administration has also ordered federal narcotics agents to stop prosecuting people who use and distribute medical marijuana (including medical marijuana doctors) in the states that have legalized it, which indicated an alteration of the course from past administrations' stringent opposition to the use of medical marijuana, even for people that have medical marijuana cards in the states that have legalized the plant for medical use. At the moment, fourteen states lawfully permit the use of medical marijuana and around twelve other states have started to think about doing so. The American Medical Association is interested in study, which takes in account alternative methods of using medical marijuana, apart from therapeutically smoking it. Lawyers for medical marijuana speak about other helpful modes of medical marijuana use, involving the THC-rich cannabis oil extraction, which is claimed to be able to heal cancer patients. Today, no one is persecuted for the use of cannabis if a legal Medical Marijuana Card is present.

The reaction of the federal government to the AMA's stance has been pretty silent in spite of loosened federal prosecution of medical marijuana use and medical marijuana clinic workers. DEA – the Drug Enforcement Administration – repeated the status of marijuana as a Schedule I substance and the FDA – Food and Drug Administration – refused to give any commentaries on the situation. The American Medical Association was one of the sole groups to object the first federal limitation on cannabis, which were established back in 1937. It still persists to decline casual idea that medical marijuana is a myth, in spite of its past support of Schedule I narcotic classification. The organization even objected an offered amendment, which would have settled its managerial policies in resistance to ingested marijuana as a safe way of use for medical marijuana treatment. In fact almost any medical marijuana clinic provides edible products of medical marijuana for patients with medical marijuana cards.

Marijuana support groups are joyous about the new stance of the AMA and the extending change of attitude towards medical marijuana and everything related to it – medical marijuana doctors, medical marijuana clinics, etc. While federal administration still resists against the medical marijuana legalization, referring to the FDA consideration in objection to its secure use as medicine, popular belief persists to change in favor of further study and medical use of marijuana. Last year, the second largest doctor group, the American College of Physicians has uttered similar support for improved research and reassessment of medical marijuana. Also, the California Medical Association passed its own opinions that referred to marijuana criminalization as a "failed public health policy."

The moods are changing towards frank research of the medical marijuana benefits. The attraction for further proof-based study by acknowledged medicinal organizations is a step in the proper direction on the way to legalizing medical marijuana for legal and safe medicinal purposes

Any Medical Marijuana Dispensary in Colorado Springs Has to Be at Least 400 Ft. from Neighborhoods

Author: jasmin

Medical marijuana dispensaries, services of cultivation and making foodstuffs would be limited to industrial and commercial zones in the Colorado Springs area and prohibited for provision within 400 ft. of residential areas, schools, drug and alcohol abuse rehab centers, and residential child day care homes under the rules issued by city planners and architects.

If the suggested land-use and zoning regulations will get approved, the proposal would be brought up prior to City Council in October, Steve Tuck, the superintendant planner of the rules' drafting, stated. Tuck said that it isn't surprising to have certain arguments, since they've had general agreement on the proposed zoning categorization. He also said that there is a lot of discordance on the 400-foot limit. The rules were drawn by Steve Tuck and representatives of the Home Builders Association, the Council of Neighbors and Organizations (CONO), the Colorado Springs Medical Marijuana Council and members of the alcohol and rehab associations.

The main suggestion was the spacing regulations akin to those adopted by the City Council for the pre-application period. This relates to an interim direction enacted in May to permit potential businesses related to medical marijuana Colorado Springs to register and elude a July 1 final date and qualify for a Colorado business certificate according to a new state law that now regulates the industry.

More than 450 pre-applications were registered, but just 176 medical marijuana dispensary Colorado facilities and cultivation sites are open in Colorado Springs at the moment. Some active shops won't be allowed by the new regulations, since they are located within the 400 ft. limit. The same issue relates to certain residential areas and all of them would need to be closed.

Tuck also stated that the rules formulated by his group are meant to comfort everyone – neighborhoods and all the business related to medical marijuana in Colorado. Of course, it won't protect everybody's interests. Tuck mentioned that their proposal would put several medical marijuana dispensary Colorado facilities that processed pre-applications out of business.

The 400-foot buffer area is much shorter than the 1,000 ft. zoning suggested by CONO for residential day care premises, schools, and drug and alcohol rehab centers. CONO's president, Dave Munger said that they assume 1,000 ft. is a good distance and setback. Munger is also running for mayor position in next April's ballot. He also mentioned that there will be a 500 ft. separation from the closest dwelling.

CONO is expected to bring up its suggestions to the Planning Commission. But Munger emphasized that his company wasn't trying to be a filibuster to medical marijuana in Colorado Springs. He also stated that the proposed regulations won't cause a perceptible disadvantage to the industry of medical marijuana in Colorado Springs and its patients. They simply try to come up with sensible rules, which would supply effective distribution with a least negative influence on neighborhoods and their dwellers.

While Steve Tuck's community has brought up land-use and zoning regulations, the City Clerk's Office is developing regulations for the way the services of medical marijuana Colorado Springs will be licensed, their fees, and other provisions. These rules' outline will go directly to City Council, since they really need the approval of Planning Commission.

Get Legal Weed in Colorado - a guide to medical marijuana

Author: Pieter Lasvegas

Many people across the Country use medical marijuana to treat a variety of ailments. Luckily for those in the state of Colorado they can now legally seek relief without fear of the law. In the November 2000 general election, the people of Colorado voted to legalize the use of medical marijuana for persons suffering from debilitating medical conditions. Amendment 20 allows a patient to have up to 2 ounces of cannabis in their possession and grow up to 6 plants.

What does this mean for you? Well, if you have one of the qualifying medical conditions then just follow this simple guide to legally apply for your medical marijuana card and you will soon be on your way to purchasing legal weed in Colorado.

First you will need to schedule a medical marijuana evaluation with a state approved doctor. There are many resources for researching and choosing a compassionate doctor across Colorado, so be sure to do the proper research to find a reputable source. It's best to provide this doctor with your medical records if possible. While this makes the process easier for everyone, it's not required at many locations.

Your doctor will need to diagnose you with one of the following conditions to be eligible for the official Colorado Medical Marijuana Registry:

  • Cancer
  • Glaucoma
  • HIV or AIDS or a medical condition or treatment that produces, for this patient, one or more of the following and which, in the physician's professional opinion, may be alleviated by the medical use of marijuana.
  • Cachexia
  • Severe Pain
  • Severe Nausea
  • Seizures (including those characteristic of epilepsy)
  • Persistent muscle spasms (including those characteristic of multiple sclerosis)

Once your doctor approves the recommendation, they will need to fill out the Physician Certification Form. Only licensed medical doctor's in good standing with the state of Colorado may sign this form. Next is your official Registry Application Form. This needs to be signed, dated and notarized in front of an official state Notary. Then you need to include a photo copy of a valid Colorado ID (driver's license, state ID, etc). Finally, a $90 non-refundable application fee must be paid by an included check or money order payable to CDPHE.

All forms are available for download from the official Colorado Department of Public Health website. Be sure to make photo copies of everything! Then package and mail all the materials to the Registry's Office within 60 days of the doctor's signature to:

Colorado Department of Public Health and Environment Medical Marijuana Registry or MMR HSVRD-MMP-A1 4300 Cherry Creek Drive South Denver, CO 80246-1530

That's really all there is to it! Next you will have to play the waiting game because the Registry's Office is currently way behind on approving new applicants. Estimated wait times can be up to 6 months from when the Registry Office receives your application. The good news is you can use photo copies of all your documents as your temporary proof of registration until you receive your official medical marijuana registry card in the mail.
